Submission to the Ontario Human Rights Commission in response to Draft Policy on Mental Health Discrimination and Police Record Checks

April 1, 2008

Some organizations, such as employers and volunteer agencies, ask for police record checks. These checks may reveal non-criminal information about an individual, including contact they have had with the police pursuant to the Mental Health Act. ARCH made a submission to the Ontario Human Rights Commission on its draft Policy on Mental Health Discrimination and Police Record Checks. In our submission we expressed the view that information about contact with the police pursuant to the Mental Health Act should never be disclosed as part of a police record check.
